PROCEDURES FOR TRIAL ATTORNEYS SEEKING A WRIT
Applicable for Trial Attorneys in Public Defender Cases
Code of Civil Procedure Article 2201 provides that supervisory writs may be applied for and granted in accordance with the constitution and rules of the Louisiana Supreme Court and other courts exercising appellate jurisdiction. This article does not limit the courts’ authority to civil cases and can be exercised in criminal jurisdictions.
As the appellate and supreme courts have jurisdiction over every action of a lower court, trial attorneys should contact LAWS for consultation if at any point during the proceedings they believe that a ruling has been made, or may be made, that is prejudicial to the accused.
